Ntcheu First Grade Magistrates Court on Monday sentenced a 26 year- old man, Tokha Nasoni to six years imprisonment with hard labour after being found guilty of sodomy.
The court heard that the victim, Pilirani Thomson, 20 who also happens to be of unsound mind as he suffers from mental disorder was sodomized on the night of May 9, 2015 when the suspect enticed him to sleep together at his house as the suspect’s brother was away.
Nasoni denied the charges saying the day he was being suspected to have committed the crime, his brother was around therefore, it was not possible to do such an act.
But the State through Ntcheu Police Station prosecution officer, Inspector Henry Chigoli paraded several witnesses besides a medical report which indicated that the victim was indeed sodomized.
However in mitigation Nasoni told the court to be lenient with him when passing judgment since he was a bread winner and that he looks after his siblings as well as his elderly grandmother.
In passing judgment First Grade Magistrate, Jones Masula quashed the mitigation factors saying the convict knew his responsibilities better which he could have considered before committing the crime.
Masula further stated that since the victim was of unsound mind, Nasoni deserves a stiffer punishment.
Both convict and victim hails from Ngalande village in the area of Traditional Authority Njolomole in the Ntcheu.
