Former Justice Minister Raphael Kasambara, one of the accused in the attempted murder of former Budget Director Paul Mphwiyo has asked Michael Mtambo, the presiding Judge to recuse himself from the case.
Kasambara filed the application this morning when the case resumed at the High Court in Lilongwe after a one month break.
The former Justice Minister, who is also representing himself in the case, accused Mtambo of being biased toward the State prosecutor which is being led by Director of Public Prosecution (DPP) Mary Kachale in the case.
Kasambara also argued that Mtambo is hearing the case because the law allows him to do so but he is already having the Judgment on the case.
Reacting to the claims, Kachale trashed the application, saying Mtambo will not recuse himself from the case as demanded by Kasambara.
Kachale claimed that Mtambo’s ruling has always been in favour of the defence team since the case started.
Meanwhile the case has been adjourned to June.
