Man sentenced to 11 years for defiling 12 year old girl in Kasungu

Kasungu First Grade Magistrate Court, on Tuesday, 31 May, 2016 convicted and sentenced Tende Efudala, 60 years to 11 years imprisonment with hard labour for defiling a 12 year old girl.

The court heard that, on February 7, 2016, the convict came to the house of the victim’s parents where he asked her to accompany him to the butchery to buy meet. As they were coming back from the butchery, the convict forced the victim into the nearby bush where he started defiling her.

Another man, who had seen Efudala with the victim passing his house became suspicious and started following them. He found Efudala doing the act and apprehended him with the help of other community members.

On 31 May, 2016, Efudala appeared before Kasungu First Grade Magistrate Court to answer the charge of Defilement which he pleaded not guilty.

The state paraded four witnesses who testified against Efudala. After parading the witnesses, the court found Efudala guilty of the offence of Defilement.

After judgement, the state through Inspector Griffin Luhanga, a prosecutor based at Kasungu Police Station requested for a stiff sentence on Efudala considering his age and that of the victim. Luhanga told the court that, people like Efudala ought to set a good example to the youth as an elder person. Luhanga further argued that, people of Efudala’s behavior are a menace to the society and should not go scot free.

Before passing sentence, Kasungu First Grade Magistrate, His Worship Damiano Banda supported Luhanga’s call and said Efudala’s behavior really showed that he is a menace to the society especially tothe young girls. Banda then sentenced Efudala to 11 years imprisonment with hard labour.
