MAN SLAPPED 14 YEARS JAIL SENTENCE FOR DEFILING TWO CHILDREN IN NKHATA-BAY

A 52-year-old man was on Friday sentenced to 14 years imprisonment with hard labour for allegedly defiling two Children and infecting them with sexual transmitted diseases in Nkhata-Bay.

Nkhata Bay Police prosecutor identified the convict as Hapster Msiska of Lweza village in the area of Traditional Authority Wasambo in Karonga.

According to Police report, in the month of March, 2015 Msiska was having sexual activities with two young girls of 11 and 14 years at Mpamba area in Nkhatabay district.

“When the matter was reported to police, Msiska was arrested and charged with the offence of having sexual activities with a child which is contrary to section 160 of the Penal Code,” reads in part the report.

When he appeared before Nkhatabay first grade magistrate court, Msiska first pleaded not guilty to the charge. In its quest to prove the case against Msiska, the state paraded four witnesses.

“After the state had proven the case against Msiska beyond reasonable doubt, Msiska was found guilty as charged and later pleaded guilty to the charge,” reads the report.

In mitigation, Msiska told the court that he takes care of his children whom their mother died some years ago.

Msiska also pleaded for leniency because if convicted he would lose his retirement benefits from the department of forest where he was working.

When passing judgement, Ngosi observed that the offence was a serious one and that the victims had been diagnosed with sexual transmitted infections hence, Msiska deserved a stiffer sentence.
