Former Justice Minister Ralph Kasambara’s dream of being released in Police cell soon following his bail revocation by the High Court has been shuttered as the Supreme Court has rejected his plea.

Kasamabara through his lawyer Modecai Msisha appealed against his bail application arguing that High Court Judge Michael Mtambo erred in revoking the bail.

Msisha said it was unconstitutional for Mtambo to revoke the bail because he was a complainant as well as a judge in a matter in which he was the aggrieved party.

During the previous court sitting, Supreme Court Judge Rezine Mzikamanda failed to deliver his ruling and adjourned the case to last week Friday.

After weighing the argument raised by the complainant, Mzikamanda threw out Kasambara’s appeal without giving any reason.

Director of Public Prosecution (DPP) Mary Kachale confirmed of the development in an interview with the press.

Kasambara is answering a conspiracy case in the shooting attempt of former Budget Director Paul Mphwiyo and the case is expected to resume on November 26, 2015 at Lilongwe High Court.
