A con artist herbalist in Dedza has been sentenced to 8 years imprisonment with hard labour for having unlawful carnal knowledge of a female without her consent contrary to section 133 of the penal code.
The incident occurred on 20th October 2016 about 6 pm at Lufesa village in the area of traditional authority Chilikumwendo when a convict Bazuka July went to the house of victim and told her that he is physician and ancestral spirit has told him to cure her pain legs.
July chased all the kids who were playing around the house saying that the herbal he was having need silent around the compass.
July ordered the victim to close the house completely to avoid disturbance.
Although the victim told him that she already bought drugs from pharmacy Mr July insisted to have vital and powerful local medicines which he said must be applied to the whole body .
The victim was later undress and told to open the legs but when a convict noticed that the victim was still insisted , he forcibly opened her legs and took herbal from dirt cloth but instead of applying them he penetrated his penis while the victims was covered on her mouth preventing her from shouting .
When he finished ejaculation he went out of the house and fled.
The case was reported to chafumbwa police unit where medical report was issued and July was later arrested.
In his sentence magistrate Symon Mwambo commended state prosecutor sub inspector Ted Namaona to prove a case beyond reasonable doubt .
Mwambo therefore handed him down to 8 years imprisonment with hard labour.
