Court puts on hold ACB appeal seeking reinstatement of Mpinganjira’s warrant of arrest

The High Court in Blantyre has put on hold an application for a stay order which the Anti-Corruption Bureau (ACB) wanted to obtain seeking reinstatement of the warrant of arrest of Thom Mpinganjira of FDH holdings limited.

Mpinganjira was arrested by ACB on Wednesday but was released on bail at midnight by the Zomba Magistrate Court.

The order by Zomba Magistrate’s Court also directed that “any further prosecutorial steps of the applicant by the Anti-Corruption Bureau be and shall be taken by way of Summons under Section 84 of the Criminal Procedures and Evidence Code”.

ACB director Reyneck Matemba this morning went to the High Court to obtain the stay order so that Mpinganjira’s arrest should still stand.

However, the ACB will have to wait until a judge will be identified to review the file and then provide direction on the way forward.

According to Patemba, the court has identified anomalies on how the order was made.
