Law Expert Says Mpinganjira’s Warrant of Arrest Cancellation is Illegal

Chancellor College Law Professor Garton Kamchedzera has described the move by the Magistrate Court in Zomba to invalidate the arrest of top banker Thomson Mpinganjira as illegal.

According to Kamchedzera, the only Magistrate that has the power to cancel a warrant of arrest is the one that issued the warrant or the High Court.

Concurring with Anti-Corruption Bureau (ACB) Director General Reyneck Matemba, Kamchedzera said the fact that this has happened is an indication of the rot in Malawi’s judicial system and a shame to the legal profession.

Mpinganjira, was arrested yesterday by the Anti-Grafting body as he allegedly of being connected with the attempts to bribe Constitutional Court Judges hearing the historic presidential election case.

Mpinganjira was later released in the early hours of today following an application his lawyers made at the Zomba Magistrate’s Court quashing the arrest warrant, subsequently releasing him.
