Former MPs Obtain an Injunction Restraining Current MPs From Conducting Parliamentary Business

Former Members of Parliament (MPs) have applied for a restraining order against the current legislators from conducting parliamentary business following court’s decision to nullify May 21, 2019 presidential election.

Earlier last week, the MPs indicated they also want the court to nullify the May 2019 parliamentary elections after court made the order over the presidential Elections.

On February 3, the Constitutional Court nullified the presidential elections which saw a Democratic Progressive Party (DPP) candidate president Peter Mutharika a winner.

When delivering the ruling the panel of five judges which presided over the case saw that the electoral body, Malawi Electoral Commission (MEC) failed to conduct the elections in free, fair and credible manner.

Following the ruling of the court former MPs argued that if the same MEC that conducted the same nullified presidential elections cannot be trusted at any cost hence their move to obtain the injunction.

The letter which has signatures of Peter Bvalani and Jessie Kabwila, is seeking the intervention of court advice.
