Supreme Court dismisses Mutharika, MEC appeal case with costs

Supreme Court of Appeal has agreed with the Constitutional Court that President Peter Mutharika was not duly elected in May 21 2019 Presidential election.

Justice Kapanda has said same voter roll used last year should be used in the fresh Elections.

The Supreme Court has also upheld the 150 days of holding a fresh election.

The court has also questioned the conduct of Mec in the litigation in both Constitutional Court and Supreme Court, saying conduct of the electoral body leaves a lot to be desired.

The court has since ordered that Mec squares the legal costs of the case for Chilima and Chakwera both in the Supreme Court and Constitutional Court.
