The High Court in Blantyre has granted an injunction to David Ndakoyiwa, effectively stopping the Democratic Progressive Party (DPP) from holding a re-run of primary elections in Nsanje South West constituency, which was scheduled for Monday, May 26, 2025.
The injunction, signed by Justice Jack Nriva on May 25, 2025, restrains the DPP the first defendant in the case from proceeding with the re-run until further order of the court.
According to the court documents, Ndakoyiwa, who emerged victorious during the initial primary elections held on May 16, claims the party’s decision to annul the results without addressing his complaints or offering a re-hearing violated his constitutional rights.
Bentry Nyondo of Ritz Attorneys at Law, representing Ndakoyiwa, confirmed the development, stating the injunction was necessary to safeguard his client’s rights ahead of the main hearing.
Justice Nriva has set an inter partes hearing for the case on May 30 at 11:00 AM.
As of this report, DPP officials are yet to comment on the injunction.
