Man to spend years in jail for raping his brother’s wife in Mchinji

Mchinji First Grade Magistrate Court has sentenced 30-year-old Maxwell Joseph to 11 years Imprisonment with Hard Labor for raping his brother’s 25-year-old wife in Mdzomba Village, Traditional Authority Zulu.

State Prosecutor Stonald Chalusa of Kamwendo Police Post told the court that on the evening of March 30, 2025, Joseph went to the victim’s house and lied that her husband was having an affair nearby.

He persuaded her to follow him to a nearby bush, claiming she would catch them in the act.

While on the way, Joseph grabbed her, wrestled her to the ground, and raped her despite her cries for help.

The victim later managed to escape, leaving behind her shoes and torn underwear, which the police recovered during a scene visit.

Medical evidence also confirmed the assault. Joseph, who was represented by a lawyer, denied the charge, but the court found him guilty based on evidence from two witnesses and the investigations.

He was convicted of rape, contrary to Section 133 of the Penal Code.

Passing the sentence, First Grade Magistrate Fred Juma Chiluhaja handed Joseph 11 years IHL, saying the punishment should serve as a deterrent to others.
