Court Halts Search Warrant Against zs’s Namuleri Farms

The Senior Resident Magistrate Court in Lilongwe has temporarily stopped the State from executing a search warrant against Namuleri Farms Limited, a farm in Kasungu owned by former Minister of Finance Simplex Chithyola Banda.
The warrant had been obtained by the State on allegations that the farm was keeping fertiliser believed to belong to the government.
However, lawyer for Namuleri Farms Limited, George Jivason Kadzipatike, applied for a stay order, arguing that the State failed to specify the batch numbers of the fertiliser allegedly in question.
Following the application, which was supported by an affidavit sworn by Kadzipatike, the court issued an order dated 15 December 2025, effectively putting the search warrant on hold. The order allows Namuleri Farms Limited to challenge the validity of the warrant before it can be executed.
Kadzipatike has confirmed that the court has scheduled an inter partes hearing for this Thursday, during which both the State and the defence will present their arguments.
The outcome of the hearing will determine whether the search warrant will be set aside or allowed to proceed.
