Court dismisses Muluzi’s appeal

The Supreme Court of Appeal has dismissed an appeal by former President Bakili Muluzi.

Muluzi was challenging Sec 32 (2)(c) on seven grounds among others that the section places the burden of proof on an accused person.

However, the court has found that Sec 32 (2)(c) does not impose any obligation on the accused person to prove their innocence.

Muluzi is accused of misappropriating money amounting to MK1.7 billion while serving as Malawi’s President.
