The Thyolo Senior Resident Magistrate’s Court has sentenced four men to nine years and five months imprisonment each for assaulting a security guard working for Mtimabi Division under Makandi Tea Estate.
The convicts have been identfied as Betungwe Tayimu (45), Patrick Nyowera (24), James Howa (31), and Aiven Bandawe (31), all hail from Traditional Authorities Chimaliro and Bvumbwe in Thyolo District.
According to state prosecutor Ishmael Abubasit, the incident happened on the night of January 15, 2025, when the four, along with another man, Samuel Bizwick, who has since been acquitted, attacked security guard Hilton Mussa.
The court heard that the group went to the estate intending to steal macadamia nuts and, in the process, severely assaulted the guard.
Delivering his ruling, Senior Resident Magistrate Kondani Chinangwa found the four guilty on five counts of assault, ruling that there was insufficient evidence to convict them on charges related to attempted theft of the macadamia nuts.
The fifth suspect, Bizwick, was found not guilty and acquitted.
