Malawi High Court Grants DPP and UTM Bid to Challenge MEC Over Smartmatic Audit Ahead of Elections

Malawi’s High Court in Blantyre has granted the Democratic Progressive Party (DPP), United Transformation Movement (UTM), and several individuals permission to review the Malawi Electoral Commission’s (MEC) decision to deny an audit of the Smartmatic Election Management System.

The court has expedited the hearing to ensure a decision before the September 16 general elections.

The DPP and UTM argued that refusing an audit is unlawful and undermines the principles of free and fair elections.

Judge Chimbizgani Kacheche agreed with the applicants, ordering strict adherence to civil procedure to conclude the matter before polling day.

The controversy surrounding Smartmatic involves concerns over procurement transparency, potential vote manipulation, and stakeholder preparedness.

Former Presidents Bakili Muluzi, Joyce Banda, and Peter Mutharika have also called for MEC to revisit its decision, citing widespread distrust and questions about the technology’s transparency and effectiveness.
