Court Dismisses DPP Challenge Against MEC Appointment ‘Andrew Mpesi’

The High Court in Blantyre has dismissed an application by the opposition Democratic Progressive Party (DPP) to challenge the appointment of Mr. Andrew Mpesi as the Electoral Services Director of the Malawi Electoral Commission (MEC).
Presiding over the matter, Justice Mandala Mambulasa ruled that the DPP failed to provide sufficient evidence that Mr. Mpesi’s appointment violated the party’s rights.
The case was filed by the Attorney General, Dr. Thabo Chakaka Nyirenda, on behalf of the state. The DPP had argued that Mr. Mpesi was unfit for the critical electoral role, alleging that he had previously performed his duties in a biased manner. The party claimed this alleged bias contributed to their loss in a parliamentary by-election in Karonga.
In its ruling, the court not only dismissed the application but also ordered the DPP to bear the full legal costs incurred in the case.
This ruling solidifies Mr. Mpesi’s position within the electoral body, allowing him to continue in his role overseeing the commission’s operations.
