Moses Kunkuyu Formally Arrested And Transferred to Kanengo Police

The Malawi Congress Party (MCP) Director of Campaign, Moses Kunkuyu, has been formally arrested today after presenting himself to the authorities this morning.
Following his arrest, Kunkuyu was immediately moved to Kanengo Police Station. His legal counsel, George Jivason Kadzipatike, confirmed the development, stating that the high-ranking official is being accused of proposing violence.
The arrest has sparked an immediate legal debate regarding parliamentary privilege. Kadzipatike argued that the arrest is unlawful because Kunkuyu is a member of the International Relations Committee of Parliament, which is currently in session.
“He is under arrest,” Kadzipatike told reporters. “The police have ignored our argument that Hon. Kunkuyu is immune from arrest because his committee is in session and that when he reported to the police this morning, he was actually enroute to Parliament.”
Under Malawian law, Members of Parliament often claim immunity from arrest while Parliament or its committees are sitting, unless the offense is of a certain criminal nature.1 It remains to be seen how the state will respond to this legal challenge.
