Malawi Electoral Commission (MEC) Chief Elections Officer Andrew Mpesi has arrived at the court in Lilongwe.
Mpesi was arrested on Wednesday afternoon on allegations of abusing his office after a person who is not an employee of the commission was found driving his official vehicle.
The case has been assigned to Senior Resident Magistrate Wanangwa Nyirenda.
Defence lawyer Chrispin Ndalama said they were informed that his client would appear in court today.
However, he described it as unfortunate that the state has proposed meeting later this afternoon instead.
