<p>Cox has made the remarks at the National Elections Consultative Forum (Necof) currently underway in Lilongwe.</p>
<p>According to Chifundo Kachale, Chairperson of Malawi Electoral Commission (MEC), the meeting is aimed at reviewing meeting of the Fresh Presidential Election held on June 23 this year.</p>
<p>The review meeting has involved every stakeholder in the polls.</p>

<div dir="auto">Spokesperson for the concerned citizens, Prince Chokhoto hints that the hearing may take place this week as their lawyer already submitted all necessary documents and are waiting for the other parties to read them.</div>

<div dir="auto">Some grounds in the matter are that if the nullified presidential election was faulty hence parliamentary and local government election results must also be nullified.</div>

<div dir="auto">In February this year, Over 100 former Members of Parliament who lost the 2019 parliamentary elections ganged up to seek a court order nullifying the outcome of the polls, citing similar irregularities that saw the results of presidential elections being declared null and void last week.</div>

<p>According to MLS vice chairperson Patrick Mpaka, the Public Procurement and Disposal Assets Authority failed to justify why MEC was allowed to use singe source procurement in the recruitment of the lawyers.</p>
<p>He also said MEC failed to provide proof of funding, as procurement entity, prior to the hiring the foreign lawyers and did not comply with Public Finance Management Act.</p>
<p>The lawyres&#8217; body has asked court that the financial transaction involved in the hiring of the South African lawyers should be declared illegal.</p>

<p>“I was very surprised with the Constitutional Court Judgement on 3 February which nullified the 21 May presidential elections results saying MEC did not manage the elections properly. I was very surprised because we as MEC we run a satisfactory, free and fair elections”, Baloyi said.</p>
<p>During the hearing, Baloyi confirmed that some ballot papers were printed locally but was not aware who printed the ballot papers</p>
<p>The Public Appointments Committee of Parliament has been meeting with MEC commissioners starting from last week to inquire into their competence in managing elections.</p>

<p>In the appeal, Ansah also argued that holding of the polls in July this year, as directed by the Constitutional Court, could be impossible citing the need for adequate preparations and funding, arguing that the poll can be held within 261 days.</p>

<p>Malawi’s electoral activities range from voter registration, submission of names of party monitors, accreditation of international and local observers, vetting of ballot papers templates, distribution of non-sensitive polling materials, receiving of ballot papers and distribution of the ballot papers.</p>
<p>The panel of five high court judges nullified the poll on February 3 and ordered that fresh poll be held within five months.</p>

<p>She said the commissioners were also shocked that correction fluid, Tipp-ex, had been widely used to correct data.</p>
<p>In the wake of the Constitutional Court ruling that nullified results of the 21 May 2019, polls, PAC has embarked on an exercise of summoning MEC Commissioners to explain their role in the whole electoral process.</p>

<p>After Malawians went to cast their votes and the electoral body Malawi Electoral Commission (MEC) declared Mutharika winner, international observers applauded the electoral process describing it free, fair and credible.</p>

<p>Hara also says Public Appointments Committee of Parliament will start meeting tommorow, Friday to look into appointment authority of MEC Commissioners as to <strong>MEC</strong> it clear who is appointing authority of MEC as ordered by the<strong> Concourt</strong>.</p>

<p>The Constitutional Court has nullified the May 21, 2019 presidential election on the basis of widespread irregularities and mismanagement by the Malawi Electoral Commission.</p>
<p>The court has further ordered that a president of Malawi should, by law, be elected by a majority vote through the acquisition of fifty per cent votes cast plus one (50+1).</p>
<p>Specifically, the Public Appointments Committee (PAC) of parliament has been tasked to look into the conduct of commissioners at the Malawi Electoral Commission (MEC) and determine if they are credible enough to conduct the fresh elections in view of the findings of the court and its ruling.</p>
<p>And in general, the Constitutional Court has also ordered the Malawi Parliament to review the appointment of the chairperson for MEC a task that has, hitherto, been with the state president.</p>
<p>Parliament has also ordered that, within 21 days, parliament should ensure an enabling environment for the elections to use the 50+1 system.</p>
<p>The order of the court now implies that Dr. Saulos Chilima returns into office as vice president of Malawi with President Peter Mutharika as his boss by virtue of the May 21, 2019 elections.</p>
<p>After eleven hours of pronouncement of what president judge Healy Potani said was a summary judgment, the five judges of the constitutional court rose to retire after 61 days of work.</p>
<p>After meandering in the nitty gritties of the case, arguments and counter arguments brought before it, the constitutional court has also given directions changing a position of the Supreme Court, a development that has taken many experts unawares including some lawyers.</p>
<p>Lead lawyer for Dr. Chakwera, Modecai Msiska has described the ruling as &#8220;what he expected and victory for the young generation&#8221; and advised young people to strive to do what is right if the country is to move forward.</p>
<p>Writing on his Facebook wall, lead lawyer for Dr. Chilima, Dr. Chikosa Silungwe says the victory in the courts was a result of team work of lawyers, IT experts and others.</p>
<p>He says; “ The harder work starts now. The urgent electoral law reform required is deep rooted. The 50+1 interpretation immediately changes our political culture. Perhaps we begin to deal with politics based on tribe.</p>
<p>There may be an appeal. However, to constitutional theorists, political scientists and others: Elections must now pass the credibility and integrity test”.</p>
<p>The judges arrived at court in Lilongwe in two millitary armoured vehicles around 8:30 in the morning showers of Monday with a helicopter hovering over the skies of the courts.</p>
<p>The pronouncement of the summary verdict was punctuated by two breaks one 15 minutes and the other one hour long. The full judgment, according to judge Potani, is 500 pages long.</p>
