A white woman tried suing a sperm bank for accidentally impregnating her with the sperm of an African-American man, not a white man like she expected, has just lost her lawsuit.
White woman Jennifer Cramblett filed the lawsuit last year, after she gave birth to a bi-racial baby following treatment at the Midwest Sperm Bank.
The sperm bank acknowledged their mistake and apologised for the mix up on their part, and gave her a full refund.
Not content with that, and turning into a bit of a dick, Cramblett decided to take the sperm bank to court for ‘wrongful birth and breach of warranty, citing the emotional and economic losses she has suffered,‘ and was trying to sue for $50,000 in damages.
She also said that ‘raising a mixed-race daughter has caused undue stress and pain for the family’.
The judge dismissed Cramblett’s claim, saying it had no merit.
They said:
Attorneys for the sperm bank had argued that “wrongful birth” suits typically apply to cases where the child is born with a birth defect that doctors should have warned parents about; in this case, the child was healthy. Cramblett had also sought damages for a “breach of warranty.” The judge rejected both claims but said that Cramblett could refile the suit as a “negligence claim…
It’s actually kind of shocking when you think about it. This woman is going through the legal system, because her baby is mixed race.
She probably starts her Facebook posts with “I’m not being racist, but..”
