Social Commentator Joshua Chisa Mbele has applied for a constitutional review of his case where he is accused of criminal libel.
His lawyer, Gilbert Khonyongwa, believes that the charge is unconstitutional and has since sent the case file to the High Court for further reference to the constitutional court.
The state in its submission indicated that it was ready to parade witnesses on the second count of publication of offensive communication.
Senior Resident Magistrate Wanangwa Nyirenda has since adjourned the matter to 2 March, 2022 as the High Court is yet to stay the case pending judicial review.
In his ruling, Nyirenda has observed that the matter needs to wait for the High Court’s move for better case management even if only one count is being affected.
