High Court judge William Msiska has struck out Norman Chisale’s defence in a case where he is being accused of assault and false imprisonment, on the basis that the defence is general and does not address specific issues.
Msiska has also found other irregularities which he says indicate lack of seriousness on the part of Chisale and they include failure to file skeleton arguments as required by Civil Procedure Rules.
Consequently, he has entered his judgment in favour of Chisale’s accuser, one Dingani Soko.
Soko sued Chisale, who was former president Peter Mutharika’s bodyguard, for allegedly drawing a gun and threatening to discharge it at Soko’s office in Area 47 before proceeding to order the police to detain him.
“The claimant further alleges that the defendant was motivated in his actions by the fact that he was at that time security aide to a sitting head of state by which fact he thought he could conduct himself as being above the law,” reads part of Msiska’s ruling.
