
Mumba vs MCP: High Court Sets June 13 for Ruling on Mzimba Central MCP Dispute

Judiciary spokesperson Ruth Mputeni has confirmed that the High Court in Mzuzu will hear the Mzimba Central constituency election dispute on Friday, June 13.
The court will decide whether the matter should be resolved through legal proceedings or an out-of-court settlement. The case, overseen by Justice Justus Kishindo, was initially scheduled for June 9 but was postponed due to the Eid ul-Adha holiday.
The dispute involves Trade Minister Vitumbiko Mumba, who is vying for a parliamentary seat under the Malawi Congress Party (MCP).
Mumba’s lawyer, Khumbo Soko, emphasized that the court’s direction is critical and expressed hope that a fresh primary election will be ordered.
On the other hand, MCP’s lawyer, Gift Dick Chimowa, stated that the party would abide by the court’s guidance.
However, Chimowa questioned the legitimacy of Mumba’s request, suggesting it was an abuse of the court process. Initially, Mumba had proposed settling the dispute outside of court, but the party later sought and was granted a discharge of the earlier injunction.
Both parties have since made their submissions in preparation for the upcoming inter-parte hearing.
