Mzimba Court Fines Man K450,000 for Causing Death by Reckless Driving

The Mzimba Second Grade Magistrate Court has fined Bruno Zifa Nyengere, 34, the sum of K450, 000 for causing death by reckless driving in a district.

The court held on July 21,2025 through the state prosecutor that the incident occurred on July 9, 2025, around 20:00 hours.Nyengere was driving a Toyota Toyace pickup, registration number NE7190, from Embangweni to Jenda.

Upon reaching Kamatawo area, he encountered the pedestrian , Alex Mithi, who was walking along the white line on the side of the road.

In an attempt to avoid hitting him, the driver tried to swerve the vehicle, but the side mirror struck Mithi, causing him to fall to the ground.

The victim sustained severe head injuries and was rushed to Jenda Hospital, where he was pronounced dead due to excessive loss of blood.

Appearing before the court, Nyengere pleaded guilty to the charge.

However In mitigation, he then asked court for leniency, stating that he is the sole breadwinner for his family and also suffers from asthma.

In submission, Sub Inspector Nyirenda urged the court to impose a stiff penalty, stressing that the offence involved the loss of human life.

He further noted that the Embangweni Jenda Road has recently seen a rise in similar accidents due to reckless driving, and a tough sentence would serve as a deterrent to other drivers.

Passing the sentence, Second Grade Magistrate Wongan Kumwenda fined Nyengere K450, 000 for causing death by reckless driving, contrary to section 126 subsection 4C of the Road Traffic Act.

The court ordered that the money be paid as compensation to the family of the deceased.

Nyengere hails from Nyengere Village, Traditional Authority Mponera, in Dowa District.
