Lawyer for Commissioner Evelyn Chisale Prays to Court not to Commit His Client at Maula Prison

Lawyer for Commissioner Evelyn Chisale, Enock Mbwana has prayed to court that police officers suspected to have a hand in the death of Buleya Lule should not be committed to Maula prison.

According to Mbwana, the accused person should be remanded at the police station for fear that prisoners might seek retribution against them.

Enock Mbwana, lawyer for Commissioner Evelyn Chisale, who is the thirteenth accused person in a suspected murder of Buleya Lule, made an application to the court that the suspect and other 12 police officers should not be committed to Maula Prison.

The Lawyer wanted the accused person to be remanded at the police station for fear that prisoners might seek retribution against them.

However, State lawyers have objected to the application that the 13 police officers be segregated at a police cell.

They have argued that prison authorities have the mandate to segregate inmates upon noticing that the ones taken there are at risk of being mistreated by fellow inmates.

Magistrate Viva Nyimba is hearing the case.

Commissioner Chisale a wife to Norman Chisale former president Peter Mutharika’s security aide was arrested together with others after being implicated in the death of Lule a suspect in the albino killing.

According to a postmortem results, Lule died from electrocution.

Meanwhile, the application has been dismissed by principle magistrate

He says their argument lacked legal basis and that if there will be need, the counsel will liaise with the State and Prison Service.

The matter has since been committed to The High Court.
