MCP RULED OUT IN KUNJE, MATHANGA CASE

The Malawi Congress Party’s (MCP) application to join the Linda Kunje and Jean Mathanga case has been dismissed by the high court sitting in Blantyre.

This follows the case in which the two commissioners are suing the Malawi Electoral Commission (MEC) and the attorney general’s office for withholding their letter of appointments.

The lawyer presenting MCP on the matter Abison Chitukula has confirmed the development stressing they are yet to seek other alternatives prior to the ruling.

“We discontinued a case challenging the appointment of the two commissioners last year. We seek to revive that case or move on with the appeal against the ruling to the Supreme Court,” said Chitukula.

According to Chitukula, the MCP’s application hearing was presided over by the Registrar of the High Court of Appeal Gladys Gondwe.

Kunje and Mathanga were found to be incompetent by the Supreme Court of Appeal in the management of the May 2019 tripartite elections despite being reappointed by the former president Peter Mutharika, a development that prompted the Tonse led administration to withhold their letters of appointment.
