Court To Deliver Judgement On State’s Application To Have Police Officer Andrew Chagaga’s Rape Case Committed To High Court For Sentencing

Magistrate Soka Banda is this afternoon expected to deliver judgement on application by the state to have police officer Andrew Chagaga’s defilement case committed to high court for sentencing.

Blantyre First Grade Magistrate Court found Chagaga guilty of defiling a 17 Year old students from Malawi University of Business and Applied Science (MUBAS).

Chagaga is said to have defiled the girl twice while she was in police custody at Limbe Police Station.

The state lawyers prayed for a stiffer punishment considering the circumstances under which the offence was committed, both during and after the commission of the offence.

The police officer is currently remanded at Chichiri Prison waiting for sentencing.

The State is being represented by three lawyers- Trevor Mphalale from Ministry of Justice’s chambers of Director of Public Prosecutions (DPP), Chikondi Chijozi from Southern Africa Litigation Centre (SALC) and Ruth Kaima from the Centre for Human Rights Education, Advice and Advocacy (Chreaa).
