Court Orders Chimwendo Banda Remanded

Lilongwe Chief Resident Magistrate Austin Banda has ordered Malawi Congress Party (MCP) Secretary General Richard Chimwendo Banda to be remanded to prison after first being taken to a hospital of his choice for medical examination
The order was made after the state, represented by Prescott Mwayiulipo, informed the court that Chimwendo Banda and Alfred Dallah Kadula are accused of attempting to murder Frank Chawanda in 2021.
The prosecution argued that the two should be sent to prison to await trial at the High Court, as the Chief Resident Magistrate’s Court is not competent to handle murder cases.
However, the court declined to remand Kadula, with Magistrate Banda questioning how the state brought him before the court when there is a High Court injunction barring his arrest and detention.
The magistrate ruled that, due to the existing injunction, Kadula would not be remanded.
Lawyers for the suspects, George Kadzipatike, Khwima Mchizi and Silvester Ayuba James, supported this position and further requested medical attention for Chimwendo Banda, citing his ill health since arrest.
They asked the court to allow Chimwendo Banda to seek treatment before being sent to prison to await the transfer of the case to the High Court.
