The Principal Resident Magistrate Court in Nkhata Bay on Wednesday 23 August 2023 has convicted and sentenced a 24-year Old man to 7 years imprisonment with hard Labour for defiling a 32-year-old mentally challenged woman.
State prosecutor, Inspector Imed Isaac has identified the convict as Issa Banda from Nyoloni Village.
Isaac told the court that the Banda was caught doing the act on the psychiatric woman on August 14, 2023 at Nyoloni Village in the district.
Banda took advantage of the women who was left at home with a woman from a neighboring house when her mother went out for other errands.
Appearing before police after being arrested, Banda pleaded guilty to the charge; claiming he did not know what he was doing.
This however prompted the state to plead for stiffer punishment; saying Banda was supposed to protect the woman than taking advantage of her situation to contravene the law.
Principal Resident Magistrate Clemence Chamwenda concurred with the state and sentenced him to 7years imprisonment.
Issa Banda hails from Nyoloni Village in Traditional Authority Mkumbira.
