The Malawi Congress Party (MCP) has withdrawn its appeal to the Supreme Court meaning the order of this court has no legal effect and the convention will proceed as planned.
Wapona Kita, lawyer for MCP, told the press yesterday evening barely minutes after the court suspended the convention following an appeal by the party.
Kita said: “ My client has instructed me to withdraw the appeal in the circumstances which means the order from the Supreme Court will have no legal to stand on.
“This means that the convention will proceed tomorrow (today) as client has weighed in on the cost of postponing the elective convention. ”
Kita said he has passed on the position of his client to the justice of appeal and the court “has taken note of our course of action. ”
