Court Orders State to Release MSCE ID in Phwedo Defilement Case

Chief Resident Magistrate Benjamin Chulu has ordered the state to serve the defence with the Malawi School Certificate of Education (MSCE) identification card which was used last year by the girl who was allegedly defiled by Tumpe Mtaya, popularly known as Phwedo.

The Magistrate has however, denied the defence application to order the State to disclose the age assessment report, saying the application is premature.

Defence Lawyer, Robert Kadzakumanja, said they will consult their client to understand if there is a need to challenge the ruling that denies them access to the age assessment report.

The Prosecution was not available to comment on the ruling made in court.

The court has since been adjourned to 12 June 2025, when the hearing is expected to commence.
