
High Court Lifts Injunction Against MCP Primary Winner in Salima South Linthipe

In a latest development, the High Court in Lilongwe has vacated an injunction that had been obtained by four contestants challenging the outcome of the Malawi Congress Party (MCP) primary elections in Salima South Linthipe Constituency.
The claimants—Aaron Kafakamoyo, Gift Kapachira, Maxwell Chimzere, and Dr. Humphreys Shumba—had moved the court on May 5 to restrain the party from recognizing Mike Mwawa as the winner of the primaries held in April. They alleged that the elections were fraught with massive irregularities and that Mwawa had exclusive access and control over the list of delegates.
However, in his ruling, Justice Howard Pemba found that the claims presented lacked sufficient evidence and did not raise serious legal questions warranting a full trial.
George Jivason Kadzipatike, the lawyer representing both Mwawa and the MCP, welcomed the court’s decision, saying it clears the path for the party to provide direction on the next steps.
