Court rules in favour of Chilima

High Court Judge Redson Kapindu has ordered the State to file the documents (evidence) being requested by Vice President Saulos Chilima to the court by Monday, 22 January 2024 before 10am.

The Judge has ordered that the State must do this for him to appreciate the evidence and make a decision on whether it is indeed confidential or not.

The State has been ordered to file the evidence directly to the judge to make the assessment in his chambers before making another determination on the matter.

Judge Kapindu has made the order, taking into consideration that matters of national security are sensitive and complex and therefore need serious and sensitive consideration.

He says his decision also comes after considering the balance of national security and right to fair trial where matters of security do not stand in the way of justice.
