Former Immigration Director General, Brigadier General Charles Kalumo (retired), is expected to appear before the Lilongwe Senior Resident Magistrate’s Court today, where he will present preliminary objections to corruption charges brought against him by the State.
According to a notice of preliminary objections, defence lawyer Chrispin Ndalama is expected to argue that the charge should have been brought by the Anti-Corruption Bureau (ACB), not the police, as it falls under the Corrupt Practices Act.
Ndalama further argues that the alleged offence, in which Kalumo is accused of issuing a diplomatic passport to Nigerian businessman Dozy Mmobuosi in 2023, stemmed from a request by a former head of state and a directive from a sitting president at the time.
He maintains that the matter raises issues of functional immunity.
